Settlement reached in death of man killed in Morgan truck crash

In previous posts we have mentioned the option for family members of someone who has died in a truck accident, to file a wrongful death lawsuit against the party responsible. While these types of cases are filed on a regular basis in courts throughout the nation, after news outlets cover these horrific crashes, the public doesn't often hear about their outcomes.  Recently one potential wrongful death lawsuit came to a close.

The matter was in conjunction with the devastating truck accident that seriously injured Tracy Morgan last year. While the comedian was hurt and continues to recover from his injuries--including a traumatic brain injury--another comedian, a 62-year-old man, died in the incident. The men, along with several other individuals were passengers in a limo van that was struck by a truck that was being operated on behalf of Wal-Mart. At the time of the crash the driver of that truck allegedly had not slept for more than 24 hours. As a result of that sudden and senseless death, the family of the man who died looked into pursing a lawsuit against Wal-Mart seeking compensation for the untimely death of their loved one.

While once filed, lawsuits such as these sometimes go to trial to be resolved, other times they are settled outside of court even before a formal complaint is filed. This is what happened here. While the specifics regarding the settlement are not clear, the attorney for the family of the deceased man indicated that his clients were pleased with the outcome. Despite not admitting liability for the collision, among other things the retailer was said to have accepted responsibility for the crash.

There are multiple benefits to a case being settled in this manner before it is even filed. It is often an easier process for those left behind to navigate and usually takes much less time.
