Driving under the influence sends Wisconsin man to prison

A Wisconsin man has vowed never to drink again. Unfortunately, he made that choice too late for himself and two passengers in a car he was driving back in Aug. 2012. At the time of the crash, he was driving under the influence.

Evidence showed the driver was going upwards of 100 mph when he slammed into the back of another vehicle. Prosecutors said there was nothing at the scene to indicate that he even attempted to stop before the collision. One passenger, a 20-year-old man, suffered fatal injuries and did not survive. The other passenger, a 24-year-old, survived the crash but not without suffering injuries.

Evidence presented by prosecutors established that the driver’s blood alcohol content was twice Wisconsin’s legal limit. At the man’s sentencing, the judge acknowledged that the man had taken steps to change his life for the better. With this in mind, he was sentenced to prison for seven years.

Even though people know that drinking and driving can have deadly results, many still drive after drinking. Despite the odds, some drivers are fortunate to make it to their destination without incident. Others, like this man, end up involved in deadly accidents. He will now will have to live the rest of his life knowing that he took a life.

However, at least he has a life to live. The passenger that died in this accident does not have that option, and his family will never see him again. The victim’s family retains the right to file a wrongful death claim against the driver, and his conviction for driving under the influence may be offered as evidence in that litigation to prove negligence. Any monetary restitution the family receives as a result of a successfully litigated claim will not return the victim to them, but it may help them with the financial impact his death caused the family.
