Deerfield man with suspended license sentenced in deadly crash

The surviving victim of a June 2012 motorcycle accident did not get the exact justice he may have wanted when Dane County Circuit Judge Julie Genovese sentenced the driver responsible to three years probation with nine months in jail. It was an accident that was emotionally difficult for the 50-year-old victim to relive in the Dane County courtroom last month, especially because it was a crash that left him seriously injured and claimed the life of his girlfriend.

Some of our Dane County readers may remember the motorcycle accident that occurred when the 35-year-old driver pulled out in front of the motorcycle that was carrying the 50-year-old man and his 47-year-old girlfriend. The 35-year-old man had been driving on a suspended license that had been taken away because of multiple drunk-driving offenses.

Because of a Nick's Law, which makes it a felony to cause death or bodily harm to another person while driving with a suspended license, the 35-year-old driver could have faced a maximum of three years in prison and three years of extended supervision, which is what the 50-year-old man had wished the judge would issue at the sentencing. But according to reports, the judge did not feel ready to send the 35-year-old man to prison at this time and instead urged him to learn his lesson during probation. She did stress however that if he failed to follow the conditions of his probation, then he would be immediately sent to prison.

As for the victim, it's unknown if he or the 47-year-old woman's family intends on taking civil actions in this case. For the 50-year-old victim, receiving compensation in a personal injury case could give him the justice he did not get from the sentencing.
