The Wisconsin State Patrol is assisting authorities in Wisconsin Rapids with an accident reconstruction. They are trying to determine who had the right-of-way at an intersection where a bicycle vs. car accident occurred. Police spent a good deal of time talking to people that may have witnessed the crash to determine which vehicle had the green light.

The man on the bicycle was attempting to cross the intersection when a northbound SUV slammed into him. Emergency personnel took the bicycle rider to an area hospital. Despite the efforts of hospital personnel, the man succumbed to his injuries and died.

The driver of the SUV did not suffer any injuries in the crash. Local police and the Wisconsin State Patrol believe they have been able to rule out both alcohol and speed as factors in the accident. At this time, it is not known what charges, if any, will be filed as a result of the investigation.

The family of the victim will have to wait for answers as to exactly how their loved one died in this car accident. His family does possess the right to file a wrongful death claim against the driver of the SUV. If they can prove in court that the driver was negligent and that negligence caused or contributed to the death of the bicycle rider, the court may award the family the costs and damages they have sustained. Costs such as medical bills and funeral expenses are recoverable in a civil action in addition to damages allowed under our state laws that the court may award.
