Drug evidence allowed in fatal motorcycle accident case

On a spring day in May 2012, 12 riders from the Muskegon Motorcycle Gang were preparing to cross the Mackinac Bridge as part of their annual Bridge Run through Michigan. It was a trip many of the riders had taken before. Nothing appeared to be out of the ordinary until a 26-year-old Wisconsin man lost control of his vehicle, crossed over the center line, and smashed into the group of motorcyclists.

The crash, which occurred near Fond du Lac, claimed the lives of two motorcycle riders that day and injured eight others. The driver was arrested and charged with the deaths and injuries of the riders. While at the hospital, syringes and narcotics were found in his pockets, evidence the man's public defender asked the court to suppress when it came time for trial.

But much to the victims' relief, a Fond du Lac County circuit court judge rejected the public defender's motion and is allowing the use of drug evidence in the criminal trial. Many of the surviving victims of the fatal accident and their families are pleased with the judge's decision and hope that justice will finally be served.

The 26-year-old man is charged with two counts of homicide by intoxicated use of a vehicle and faces several charges associated with reckless driving and injury to other drivers. A date has not been determined for the upcoming trial. No civil charges appear to have been placed against the man either, though there still could be a possibility in the future.
