A bus vs. SUV crash has left a Wisconsin man dead. The family of the deceased SUV driver may file a wrongful death claim against the driver of the bus and the city company he worked for, Belle Urban System. Authorities are still investigating the accident.

The Racine Police Department has enlisted the help of the Wisconsin State Patrol’s Technical Reconstruction Unit to help determine what happened and when. According to a witness, there was northbound and southbound traffic in the intersection prior to the accident. The SUV was part of the northbound traffic when the accident occurred.

The witness went on to say that the light for the eastbound bus may have just turned green when the bus entered the intersection. However, the witness said it also appeared that the bus had not even attempted to slow down as it approached what was a red light. The bus driver has been placed on administrative leave pending the outcome of the investigation.

Even if no criminal charges are filed against the bus driver, the family retains the right to file a wrongful death action in connection with their loved one’s death. Of course, nothing will bring him back, but successfully litigating a civil action may give the family a sense of justice. In addition, it may help the family defray at least some of the costs they have incurred in connection with his death. If the family is able to prove that the driver was negligent by contributing to or causing the fatal accident, the family may be awarded monetary damages allowable under Wisconsin law.
