Car accident leads to fatal injuries in Wisconsin

Drivers in Wisconsin know that when they should driver differently in inclement weather than when the sun is shining. There are several weather and natural phenomena that can reduce visibility on the roads and make it more difficult to drive. The possibility of having a car accident when visibility is reduced becomes greater.

For example, a grass fire near a roadway can cause a haze over the road that reduces visibility. Authorities believe that this condition may have contributed to the cause of an accident that ultimately killed someone. A 61-year-old driver swerved to escape hitting a vehicle in front of her and ended up rear ending another vehicle.

When the vehicles came to a rest, both drivers exited their vehicles. Unfortunately, they didn't get themselves or their vehicles out of the way of traffic, and another vehicle hit the car of the 61-year-old woman. When that happened, the vehicle was shoved into the two women who had exited their vehicles. The driver of the third vehicle only sustained minor injuries.

The 61-year-old woman was taken to Tomah Memorial Hospital with possibly life threatening injuries. Medical personnel at Tomah Memorial Hospital later decided to have her flown to another Wisconsin hospital. The woman whose car was originally hit by the 61-year-old woman suffered fatal injuries and was pronounced dead at the scene.

Reality often interferes with a family's ability to grieve for a loved one. There are arrangements to be made and costs to be paid as the family struggles to come to terms with what occurred in the car accident. The family of the deceased woman retains the right to file a wrongful death action against any party or parties whose negligence is deemed to have caused or contributed to her death. While it remains to be seen what legal actions will be pursued, if any, our state law provides for the right of victims (or the surviving family in the event of a fatality) to seek monetary relief by proving the injuries or death resulted from the negligent conduct of others.
