Auto accident kills Wisconsin man

An unidentified Wisconsin man was killed at the 4500 block of West Loomis Road in Greenfield. The identity of the 54-year-old man was not released pending notification of his death to his family. The Greenfield Police have indicated that the pedestrian victim of this auto accident is from South Milwaukee.

The man was pronounced dead at the scene after being struck by a Cadillac Escalade operated by a 31-year-old woman headed northeast. The man was walking in a southwesterly direction near the curb of the road. Another motorist told a local radio station that he saw the man walking just before he was hit by the Cadillac. Police do not believe that alcohol or drugs were a factor in the accident.

The Greenfield Police have asked the Wisconsin State Patrol to assist with the investigation of the accident. It is unknown at this time whether any charges will be filed against the driver. Once the victim's family has been notified, the driver of the Cadillac may find herself facing a wrongful death action, regardless of what action is taken by authorities.

The family of the victim of this accident retains the right to file a wrongful death action against the party or parties deemed to have negligently caused his death. In order to prevail in a wrongful death action, the family must prove that the party or parties identified as having been the cause of their loved one's death was negligent in causing or contributing to the fatal accident. If this man's family is able to prove that the driver of the Cadillac is legally responsible for his death, a civil court may award the family monetary damages for expenses they incurred as a result of his death, along with other damages allowed under our state laws.
