Motorcycle vs. car accident in Wisconsin kills motorcycle rider

There were two accidents involving motorcycles only hours apart on June 17 in the Wisconsin town of Kenosha. Details about one of the accidents hasn't yet been released, except to report that the rider was not seriously injured and was taken to a local hospital. The second motorcycle vs. car accident ended with the death of the motorcycle rider.

A 69-year-old man driving an SUV was pulling out of a parking lot near the intersection of 52nd Street and 39th Avenue. A motorcycle that was heading south on 39th Avenue was unable to stop when the SUV pulled out into its path. The two vehicles collided.

Emergency personnel originally called for a helicopter to take the rider to the hospital, but that request was cancelled. They were able to get the motorcycle rider to the hospital where medical personnel attempted to save his life. Unfortunately, their efforts were in vain and the rider died as a result of the injuries he sustained in the crash. The driver of the SUV was not injured, and police do not believe he was impaired. However, the driver did give authorities a toxicology sample voluntarily, and those test results are pending.

There is no word yet whether any charges will be filed in connection with this motorcycle vs. car accident. Even so, the family of the motorcycle rider does have the right to file a wrongful death claim against the driver of the SUV under Wisconsin law. Even if he is not found to be criminally liable in the crash, if it can be shown he contributed to the rider's death, the family may be awarded costs and damages.
