26 car accident on Wisconsin Highway 41: Road conditions a factor

Winter weather in Wisconsin has been the cause of more than a few accidents over the years. This year has been no exception. A pile up on Highway 41 involved approximately 26 cars, and another car accident in Nekimi resulted in a fatality.

Amazingly, police report that there were no serious injuries reported at the scene of the 26 car pileup. Three people suffered injuries that required they be taken to an area hospital for treatment. Their current condition is unknown. Authorities say they responded to dozens of accidents on the same day, all with no serious injuries.

The situation was different in Nekimi. The driver of a box truck that was traveling north on Wisconsin Highway 26 lost control. When that happened, the box truck flipped over onto another vehicle. The driver in the vehicle the box truck landed on died as the result of the injuries sustained in the accident.

There are times when the true nature and extent of a person's injuries is not known until days or even weeks after having been involved in an accident. Anyone that discovers they were more seriously injured than it seemed at first may need to seek medical attention as soon as it becomes obvious there is a continuing problem. In addition, that person has the right to file a personal injury claim in connection with the accident to recoup the out-of-pocket expenses and other damages incurred as a result of being injured.

The family of the man killed in the Nekimi car accident may file a wrongful death claim against the driver of the box truck and any separate owner of the vehicle. If they are able to show that the driver was negligent and that the driver's actions caused the fatality, they may be awarded the costs and other damages as provided under our personal injury laws. Monetary compensation could never replace a loved one, but it may help the family recover financially from a devastating tragedy.
